Nectr Energy Inc. ("Nectr," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect about you, how we use and share it, and the rights and choices you have. It applies to nectr.energy, related subdomains and storefronts, and any other site, app, or service that links to this Policy (collectively, the "Services").

By using the Services, you agree to the practices described here. If you do not agree, please do not use the Services.

1. Quick Summary

  • We collect information you provide (account, order, payment, contact) and information collected automatically (device, browsing, location).
  • We use it to fulfill orders, run subscriptions, provide customer service, market our products, prevent fraud, and comply with law.
  • We share personal information with service providers (Shopify, Klaviyo, payment processors, carriers) and with advertising partners (Meta, Google, TikTok) for cross-context behavioral advertising.
  • You can opt out of marketing, advertising "sharing," and certain other uses at any time. California, EU/UK, and several other-state residents have specific legal rights described below.
  • We honor Global Privacy Control (GPC) signals as a valid opt-out of sale/sharing under applicable law.

2. Information We Collect

We collect the following categories of personal information:

Identifiers and contact information. Name, email address, postal address, phone number, account credentials, IP address, device identifiers, customer/account ID.

Commercial information. Products purchased, order history, subscription details, returns, cart and browsing activity on the Services, preferences.

Payment information. Payment card or other payment method information, billing address. Payment card numbers are collected directly by our payment processors (such as Shopify Payments, Stripe, or PayPal) and are not stored by Nectr.

Demographic and profile information. Age verification (we sell only to customers 18+), birthday (if you provide it), preferences.

User-generated content. Reviews, photos, videos, social posts, comments, and other content you submit to Nectr or our channels.

Communications. Emails, SMS, live chat, and support tickets with us.

Online activity and device information. Browser type, operating system, device type and identifiers, referring URL, pages viewed, links clicked, time on site, search terms, and similar interaction data, collected via cookies, pixels, SDKs, and similar technologies.

Approximate geolocation. Derived from IP address or shipping address — typically city, state, country. We do not collect precise geolocation without your consent.

Sensitive personal information (limited use). Account log-in credentials. We do not use or disclose sensitive personal information for purposes other than those permitted under applicable law without offering you the right to limit such use.

We do not knowingly collect Social Security numbers, driver's license numbers, financial account information beyond what's needed for a transaction, biometric data, precise geolocation, or information about a known minor under 13.

3. How We Collect Information

  • Directly from you — when you create an account, place an order, sign up for emails or SMS, contact customer service, or submit a review.
  • Automatically — through cookies, pixels, tags, SDKs, and analytics tools when you use the Services.
  • From third parties — including Shopify, payment processors, fraud-prevention services, shipping carriers, marketing platforms (such as Klaviyo), social media platforms when you interact with us there, advertising partners, and publicly available sources.

4. Cookies and Similar Technologies

We and our partners use cookies and similar technologies for:

  • Strictly necessary purposes (logging you in, processing checkout, fraud prevention);
  • Analytics (understanding how the Services are used);
  • Personalization (remembering preferences);
  • Advertising and measurement (showing relevant ads on Nectr and other sites and measuring their effectiveness).

You can manage cookies through your browser settings, our cookie preferences tool (if available on the Services), or the specific opt-outs described in Section 9. Many browsers transmit a Global Privacy Control (GPC) signal — we treat GPC as a valid opt-out of sale and sharing for the browser sending it.

5. How We Use Personal Information

We use personal information to:

  • Fulfill orders and subscriptions — process transactions, ship products, manage renewals, send order and shipping confirmations, handle returns and store credit.
  • Provide customer service — respond to inquiries, resolve disputes, investigate complaints, send service messages.
  • Manage your account — authenticate you, save preferences, and personalize your experience.
  • Marketing — send promotional emails and (with your consent where required) SMS, deliver targeted advertising on third-party sites and social platforms, conduct surveys, run sweepstakes or contests.
  • Analytics and product improvement — understand how the Services are used, measure performance, develop new products and features.
  • Fraud prevention and security — verify identity, detect and prevent fraudulent transactions and chargeback abuse, enforce our Terms of Service, protect the rights and safety of Nectr, our customers, and others.
  • Legal and compliance — comply with applicable law, respond to lawful requests, enforce agreements, and protect our legal interests.

6. SMS and Email Marketing

Email. If you provide your email address, we may send you marketing emails. You can unsubscribe at any time by clicking the "unsubscribe" link in any marketing email or contacting [email protected]. Transactional emails (order confirmations, shipping updates, subscription notices) are not marketing and will continue.

SMS. If you opt in to SMS marketing — by entering your phone number into an SMS sign-up field, checking an SMS box at checkout, or texting a designated keyword — you expressly consent to receive recurring marketing text messages from Nectr at the mobile number provided, sent using an automatic telephone dialing system or other automated technology. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.

To opt out, reply STOP to any Nectr SMS message. For help, reply HELP or contact [email protected]. You may also receive a transactional SMS confirming your opt-out. Carriers (such as AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.

By opting in to SMS, you confirm you are the subscriber or authorized user of the mobile number provided and are at least 18 years old.

7. How We Share Personal Information

We share personal information in the following ways:

Service providers. We share personal information with vendors that perform services on our behalf, such as:

  • E-commerce and payments — Shopify, Stripe, PayPal, and similar processors;
  • Email and SMS marketing — Klaviyo and similar platforms;
  • Shipping and fulfillment — carriers (USPS, UPS, FedEx, DHL), 3PLs, and warehouse providers;
  • Customer service — help desk and chat platforms;
  • Analytics — Google Analytics, Shopify analytics, and similar;
  • Fraud prevention and identity verification — including providers like Signifyd, Kount, or similar;
  • Cloud hosting and IT services.

These providers are contractually limited to using the information only to perform services for Nectr.

Advertising partners. We share certain online identifiers, device information, browsing and purchase activity, and other limited personal information with advertising partners — including Meta (Facebook and Instagram), Google, and TikTok — to deliver targeted ads, measure ad performance, and build audiences for marketing campaigns. Under California law, this is considered "sharing" for cross-context behavioral advertising and "selling" of personal information; you have the right to opt out as described in Section 9.

Corporate transactions. In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, personal information may be transferred to the successor entity.

Legal and safety. We may disclose personal information to comply with law, lawful requests from authorities, court orders, or legal process; to enforce our Terms; to protect the rights, property, or safety of Nectr, our customers, or others; and to investigate fraud, security incidents, or violations of our policies.

With your consent. We may share personal information for other purposes with your consent or at your direction.

Aggregated or de-identified information. We may share aggregated or de-identified information that cannot reasonably be used to identify you for any lawful purpose.

8. Data Retention

We retain personal information for as long as needed to provide the Services, comply with legal obligations (tax, accounting, fraud, recordkeeping), resolve disputes, and enforce agreements. Typical retention periods:

  • Account and order records — for the life of your account and at least seven (7) years after your last order, for tax and accounting purposes;
  • Marketing data — until you unsubscribe or three (3) years of inactivity, whichever is shorter;
  • Customer service records — three (3) years after resolution;
  • Logs and analytics — generally 24 months or less.

When personal information is no longer needed, we delete, anonymize, or aggregate it.

9. Your Privacy Rights and Choices

9.1 All customers

You can:

  • Update your account information at any time at nectr.energy/account;
  • Unsubscribe from email marketing by clicking the unsubscribe link in any marketing email;
  • Stop SMS marketing by replying STOP to any Nectr SMS;
  • Manage cookies through your browser settings;
  • Opt out of certain ad targeting via the AdChoices program (youradchoices.com), Network Advertising Initiative (networkadvertising.org/choices), Meta ad settings, Google ad settings, and TikTok ad settings.

9.2 California residents (CCPA/CPRA)

California residents have the following rights regarding personal information collected in the past 12 months:

  • Right to know what personal information we collect, the sources, the purposes, and the categories of recipients.
  • Right to access a copy of your personal information in a portable format.
  • Right to delete personal information, subject to legal exceptions.
  • Right to correct inaccurate personal information.
  • Right to opt out of sale and sharing of personal information for cross-context behavioral advertising. We honor Global Privacy Control (GPC) signals.
  • Right to limit use of sensitive personal information — note: we do not use sensitive personal information beyond purposes permitted by the CCPA, so this right does not currently apply to our processing.
  • Right to non-discrimination for exercising your rights.

To exercise these rights, email [email protected] or use the "Do Not Sell or Share My Personal Information" link in the Services footer. We will verify your identity using account information or other identifiers. You may use an authorized agent — provide written, signed authorization.

We do not knowingly sell or share the personal information of minors under 16 without affirmative authorization.

9.3 Other US state residents

If you reside in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Indiana, Tennessee, New Hampshire, New Jersey, Minnesota, Maryland, or another state with a comprehensive consumer privacy law, you have rights similar to those described above, including the right to access, correct, delete, port your data, and opt out of targeted advertising, sale of personal information, and certain profiling. The exact scope and process depend on your state's law. To exercise these rights, email [email protected].

You may appeal a denial of a request by replying to our decision email; we will respond within the timeframe required by your state's law.

9.4 United Kingdom residents (UK GDPR)

Nectr does not ship to the European Union, EEA, or Switzerland. If you are in the United Kingdom, Nectr is the controller of your personal data. Our legal bases for processing include:

  • Contract — to fulfill orders, run subscriptions, and provide the Services;
  • Legitimate interests — for fraud prevention, analytics, product improvement, and direct marketing of similar products to existing customers (you may object at any time);
  • Consent — for SMS marketing, certain cookies, and other processing where required by law;
  • Legal obligation — for tax, accounting, and other compliance.

You have the right to:

  • Access your personal data;
  • Rectify inaccurate data;
  • Erase ("right to be forgotten") subject to legal exceptions;
  • Restrict or object to processing;
  • Data portability;
  • Withdraw consent at any time (without affecting prior processing);
  • Lodge a complaint with the UK Information Commissioner's Office (ICO).

International transfers. Nectr is based in the United States. When we transfer personal data from the UK to the U.S. or other countries, we rely on appropriate safeguards, including the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses.

9.5 Canadian residents (PIPEDA)

If you are in Canada, you have the right to access and correct your personal information and to withdraw consent for certain uses, subject to legal and contractual restrictions. To exercise these rights, email [email protected]. You may also file a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca).

9.6 Response time

We will respond to verifiable consumer rights requests within the timeframe required by applicable law (typically 30 to 45 days). We may extend this period if reasonably necessary and will notify you.

10. Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Customers must be at least 18 years old to make a purchase. If you believe a child under 13 has provided us personal information, contact [email protected] and we will delete it.

11. Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, access controls, and monitoring. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

If we experience a breach of personal information, we will notify affected individuals and regulators as required by law.

12. Third-Party Links and Services

The Services may link to third-party websites, apps, or services we do not operate. This Policy does not apply to those third parties. Review their privacy policies before sharing personal information with them.

13. Do Not Track

Some browsers transmit "Do Not Track" (DNT) signals. Because no industry standard for DNT has been adopted, we do not currently respond to DNT signals. We do, however, honor Global Privacy Control (GPC) signals as described in Section 9.2.

14. Changes to This Policy

We may update this Policy from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated by email to active customers or by prominent notice on the Services. Your continued use of the Services after the effective date constitutes acceptance.
